I am a constituent and a [developer / researcher / user] of language models. I am writing to ask you to oppose any bill that would require a license, registration, safety certification, or compute-threshold reporting before a language model can be trained, published, or used.

A language model is made of language: source code, a file of numbers, and the words it produces. Federal courts have held that code is protected speech (Junger v. Daley, 209 F.3d 481 (6th Cir. 2000)), and the Supreme Court has held that the creation and dissemination of information is speech (Sorrell v. IMS Health, 564 U.S. 552 (2011)). A requirement to obtain permission before publishing text is a prior restraint.

Where lawmakers describe models as dual-use weapons, the Second Amendment applies instead. District of Columbia v. Heller extends the right to keep and bear arms to all bearable instruments, including those that did not exist at the founding.

Existing law already punishes fraud, defamation, harassment, and weapons offenses. Please enforce those laws against the people who break them rather than licensing the tools everyone else uses lawfully.

3 · Comment on rulemakings

Put it on the record.

Agencies must respond to substantive comments. When the Bureau of Industry and Security or a state agency proposes a rule on model weights or model deployment, supporters receive the docket number and a comment template. Comments can be filed at regulations.gov.
